Ooobar Freight ("Ooobar", "we", "us") operates a technology platform and mobile applications that connect businesses that need to ship freight ("Shippers") with independent owner-operators who provide transportation services ("Drivers"). Ooobar is a technology platform โ not a motor carrier, freight broker of record, transportation provider, or insurer. Independent third-party contractors operate all vehicles.
By creating an account or using the platform you agree to these Terms. If you do not agree, do not use the platform. During early access, features and terms may change frequently.
Drivers are independent contractors operating their own businesses. Nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship between Ooobar and any Driver. Drivers control their own vehicles, schedules, routes, and which loads they accept, and are solely responsible for their business licenses, commercial insurance, permits, taxes, and compliance with all applicable laws, including hours-of-service rules.
You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. We may suspend or terminate accounts that violate these Terms or applicable law.
The platform surfaces available loads and estimated pricing based on a published rate schedule (per dispatch mile by vehicle class, minimum dispatch charge, accessorials, and fuel adjustment). Rates shown during early access are samples and subject to change. Drivers see the applicable rate before accepting a load.
Payments are processed by our third-party payment provider (e.g., Stripe). Shippers authorize payment at booking; funds are held and released to the Driver after confirmed delivery. Ooobar charges a platform fee (a percentage of the transaction) for use of the software and marketplace. Optional instant payouts may carry a small processing fee. Ooobar does not take custody of funds beyond what the payment provider facilitates.
Any cargo coverage or insurance products offered through the platform are provided by independent, licensed third-party partners, subject to those partners' terms, eligibility, and pricing. Ooobar is not an insurer or insurance agency and does not guarantee coverage.
The app provides tools for Drivers to keep their own duty and trip records. These records belong to the Driver and are provided as a convenience; Drivers remain solely responsible for meeting any recordkeeping and hours-of-service obligations that apply to their business.
You agree not to misuse the platform, including by providing false information, interfering with its operation, infringing others' rights, or using it for unlawful purposes.
The platform is provided "as is" without warranties of any kind to the fullest extent permitted by law. We do not warrant uninterrupted or error-free operation, nor the acts or omissions of any Shipper, Driver, or third-party partner.
To the fullest extent permitted by law, Ooobar is not liable for indirect, incidental, or consequential damages, and our aggregate liability is limited as set out in the final version of these Terms. [Attorney to specify caps and carve-outs.]
We may update these Terms; continued use means acceptance. Governing law, venue, and dispute-resolution terms will be specified here. [Attorney to complete based on your entity's home state.]
